The New York State Court of Appeals and the Third Department require that appellate documents are actually filed on or before the day they are due, rather than allowing postmarks as some courts do. Until now, this would mean that an attorney, located outside Albany, would need to have final documents ready for preparation at a minimum the night before these documents are due in court.
